Booking Terms

1. About AYVA and these terms
AYVA is a booking and payment platform operated by AYVA Software (Pty) Ltd, registration number 2022/856769/07, a company registered in South Africa ("AYVA", "we", "us" or "our"). Studios use AYVA to publish sessions and classes, take bookings and collect payments.
These Booking Terms apply to you when you create a booking account, make a booking, or buy a package, credits or a subscription through AYVA ("you" or "your"). By doing any of these, you accept these terms.
2. Our role: the contract is with the studio
When you book or pay for a session, class, package or subscription, you are entering into an agreement with the studio that offers it, not with AYVA. The studio is responsible for the services it provides to you. AYVA provides the software and payment tools that make the booking and payment possible. We are not the provider of the sessions and are not a party to your agreement with the studio.
The studio sets its own prices, schedules, packages, credits, and cancellation and refund rules. A studio may also publish its own terms of use. Where it does, those terms apply to your relationship with that studio in addition to these Booking Terms, and the studio's terms govern studio-specific matters such as cancellations and refunds.
3. Bookings, packages, credits and subscriptions
The studio may offer any of the following:
- Drop-in bookings. A single booking for a session or class at the price set by the studio.
- Packages and credits. A package you buy upfront that gives you a number of booking credits to redeem against future bookings. Packages may have an expiry date set by the studio, after which unused credits may no longer be valid.
- Subscriptions. A recurring plan that is charged at regular intervals set by the studio, and that may give you a set number of bookings per interval. You can cancel a subscription to stop future charges, as described in the Service.
- Credit balance. You may hold a credit balance with a studio. Credits may be cash credits or booking credits. Cash credits are generally refundable, while booking credits are not refundable and can only be used to make bookings, in each case subject to the studio's rules.
4. Cancellations and refunds
Cancellation and refund rules are set and controlled by each studio. AYVA provides tools that apply the studio's rules, including a cancellation threshold (a cut-off time before a session). As a general default, where a studio uses thresholds:
- If you cancel before the threshold, your payment is typically returned to your credit balance with the studio;
- If you cancel within the threshold, you may not be entitled to a refund or credit.
These are defaults only. The studio decides its actual cancellation and refund policy and can apply, change or override it, including making discretionary refunds or credits. Any refund or credit you are owed comes from the studio. AYVA does not decide these outcomes and does not issue refunds on a studio's behalf.
If a studio cancels a session, the studio is responsible for refunding or crediting you in line with its policy and applicable law.
5. Payments
Payments you make through AYVA are processed by our payment partner, Paystack, and are settled to the studio. AYVA does not hold or take ownership of the money you pay. Your card details are handled securely by Paystack and are not stored by AYVA.
Prices are set by the studio and shown to you before you pay. AYVA is not a registered VAT vendor and makes no representation about VAT on your booking. Whether any VAT applies to what you pay is a matter between you and the studio, depending on the studio's own VAT status.
6. Your account and conduct
You must give accurate details when you book and keep your account secure. You are responsible for activity under your account. You must not use AYVA for any unlawful purpose, attempt to interfere with the platform, or make bookings or payments fraudulently.
A studio may ask you to accept an indemnity or waiver before taking part in a session. That arrangement is between you and the studio.
7. Personal information
The studio you book with is the responsible party for your personal information and decides how it is used in connection with your bookings. AYVA processes your personal information as the studio's operator and, for your booking account and our direct relationship with you, as a responsible party in its own right. How we handle personal information is described in our Privacy Policy.
8. Availability and liability
We work to keep AYVA available and reliable, but we provide the platform "as is" and do not warrant that it will be uninterrupted or error-free. To the extent permitted by law, AYVA is not liable for the services a studio provides, for a studio's cancellation or refund decisions, for disputes between you and a studio, or for any indirect or consequential loss. Nothing in these terms limits any rights you have that cannot lawfully be excluded, including under the Consumer Protection Act.
9. Changes and governing law
We may update these Booking Terms from time to time, and the current version will always be available here. These terms are governed by the laws of the Republic of South Africa, and the South African courts have non-exclusive jurisdiction over any dispute.
